These Terms of Service (“Terms”) govern your use of NutriCoach (“the App”), operated by Perfect Fit Training and Nutrition (“we,” “us”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The service
NutriCoach provides nutrition-tracking, meal-planning, and coaching tools, including AI-assisted features. We may add, change, or remove features at any time.
2. Eligibility & accounts
- You must be at least 18 years old, or use the App under the supervision of a parent, guardian, or healthcare provider.
- You are responsible for keeping your login credentials secure and for all activity under your account.
- Provide accurate information and keep it up to date.
3. Coaches and clients
The App connects coaches with clients. Coaches are independent and are solely responsible for the guidance they provide to their clients. We are not a party to the coach–client relationship and do not endorse or verify any coach’s qualifications unless expressly stated.
4. Not medical advice
The App does not provide medical advice. You agree to the terms of our Health & Nutrition Disclaimer, which is incorporated into these Terms. Always consult a qualified professional regarding your health.
5. AI features
AI-generated plans, responses, and nutrition estimates are provided “as is” and may be inaccurate. You are responsible for reviewing and using them at your own discretion.
6. Acceptable use
- Do not use the App for any unlawful purpose or in violation of these Terms.
- Do not attempt to disrupt, reverse-engineer, or gain unauthorized access to the App or other users’ data.
- Do not upload content that is harmful, infringing, or that you do not have the right to share.
7. Your content
You retain ownership of the information and content you submit. You grant us a limited license to use it solely to operate and provide the App to you and, where applicable, to your coach.
8. Payments
Some features or plans may require payment. Applicable fees, billing terms, and refund policies will be presented to you before you purchase. If no paid plan applies to you, this section does not affect your use of free features.
9. Termination
You may stop using the App at any time. We may suspend or terminate access if you violate these Terms or to protect the App or its users.
10. Disclaimers & limitation of liability
The App is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, Perfect Fit Training and Nutrition and its coaches will not be liable for any indirect, incidental, or consequential damages, or for any health outcomes, arising from your use of the App.
11. Indemnification
You agree to indemnify and hold harmless Perfect Fit Training and Nutrition from claims arising out of your use of the App or violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules.
13. Changes
We may update these Terms; the “Last updated” date reflects the latest version. Continued use means you accept the changes.
